Referring to Gotabhaya Rajapakse's interview to the BBC Tuesday where Mr Rajapakse said that he would not allow any war crimes investigation in Sri Lanka, Professor Francis Boyle, an expert in International Law and a professor of Law at the University of Illinois College of Law said, "Defense Secretary Rajapaksa has now publicly and definitively ruled out any investigation of war crimes by the Government of Sri Lanka. And he is a government official acting within the scope of his official duties so that his statement binds the State of Sri Lanka under international law. Hence the basic requirement of international law mandating "complementarity" has been satisfied.

"In other words, a sovereign state must first be given the opportunity to investigate and prosecute war crimes committed by its own armed forces. Only if the sovereign state fails or refuses to do so, can international bodies step in to conduct those investigations and prosecutions such as the International Criminal Court," Prof. Boyle said.

"In this case, U.N. Special Rapporteur Philip Alston has called for such an investigation. U.N. Secretary General Ban Ki-moon has indicated that he would be prepared to consider such an investigation.

"Now that Defense Minister Rajapaksa has rejected such an investigation by the GOSL itself, under international law the onus is now upon U.N. Secretary General Ban Ki-moon to appoint a war crimes investigation body with respect to Sri Lanka as he has recently done in Africa," Prof. Boyle added.

"The Governments of the United States and the United Kingdom must pressure Ban Ki-moon to do the right thing here for the Tamils on Sri Lanka," Professor Boyle further said of the role of the U.S.and U.K. in applying pressure to the U.N. to begin investigations of war crimes allegedly committed by the Sri Lanka Army against Tamil civilians.

சர்வதேசம் இங்கு எந்த விசாரணையை நடத்தக் கேட்டாலும் நான் ஒரு போதும் அதற்கு அனுமதிக்கப் போவதில்லை. நான் அதனை முற்றாக எதிர்க்கிறேன். ஏனெனில் அவ்வாறான விசாரணைக்கு இங்கு எந்த அவசியமும் இல்லை. இவ்வாறு பாதுகாப்பு அமைச்சின் செயலாளர் கோத்தபாய ராஜபக்ஷ பி.பி.ஸி. தொலைக்காட்சிக்கு அளித்த நேர்காணலில் தெரிவித்துள்ளார்.

நேர்காணலின் போது கோத்தபாய கூறியவை வருமாறு
நாங்கள் இந்த நாட்டை அபிவிருத்தி செய்ய வேண்டியுள்ளது. சமாதானத்தை உருவாக்க வேணடியுள்ளது. இணக்கப்பாட்டை ஏற்படுத்த வேண்டியுள்ளது. செய்ய வேண்டியவை இவைதான். இதைவிடுத்து பல்வேறு உள்நோக்கங்களுடன் போர்க்குற்றங்கள் குறித்து விசாரணை நடத்த வேண்டும் என்று ஐக்கிய அமெரிக் காவோ அல்லது வேறு எந்தவொரு நாடோ கேட்டாலும் அதற்கு நான் ஒரு போதும் அனுமதிக்கப்போவதில்லை. இந்த நாட்டில் அவ்வாறான தவறான விடயங்களெதுவும் நடைபெறவில்லை. நான் அவ்வாறான எத்தகைய விசாரணைகளுக்கும் அனுமதிக்கப் போவதில்லை. இந்நாட்டு மக்களுக்கும் அது தேவையில்லை. இந்த நாட்டுக்கும் அது தேவையில்லை.

எந்த விசாரணையைப் பற்றியும் எந்தக் கேள்விகளையும் என்னிடம் கேட்க வேண்டாம். அவ்வாறான எந்த விசாரணைக்கும் இங்கு இடமில்லை. நான் அதனை ஒரு போதும் அனுமதிக்கப் போவதில்லை. பாதுகாப்பு அமைச்சின் செயலாளர் என்ற வகையில் இதனை நான் கூறுகிறேன். இது தான் எனது இறுதி முடிவாகும். எத்தகைய விசாரணைகளுக்கும் இங்கு இடம் இல்லை.

புலிகள் தங்களை மீள ஒருங்கமைக்க முடியாது
புலிகள் ஒழிக்கப்பட்டு விட்டார்கள். எந்தவொரு அமைப்பும் தங்களை மீள ஒருங்கமைத்துக் கொள்ள முடியும். ஆனால் இவர்களால் மீள ஒருங்கமைத்துக் கொள்ள முடியாது என்பதனை நான் உறுதிப்படுத்துகிறேன். எதிர்க்கட்சி வேட்பாளரும் முன்னாள் இராணுவத்தளபதியுமான சரத் பொன்சேகாவை நாங்கள் ஒரு போதும் கைது செய்ய முயற்சிக்கவில்லை என்றார்.

பொன்சேகாவுக்கு எதிராகச் சட்ட நடவடிக்கை
சரத் பொன்சேகாவை நீங்கள் ஒருபோதும் கைது செய்யப்போவதில்லையா என்று கேட்டதற்கு அவர் அளித்த பதில் வருமாறு  கைது என்பது வேறு விடயம். அவர் பல தவறுகளை விட்டிருக்கிறார். அவர் பாதுகாப்பு கவுன்ஸிலின் உறுப்பினர். மூன்று மாதத்திற்கு முதல்தான் அவர் அதிலிருந்து விலகினார். ஆனால் அவர் சில பாதுகாப்பு இரகசியங்களை பகிரங்கப்படுத்தி இருக்கிறார். அவர் அதில் பிழை விட்டிருக்கிறார். நான் தவறான உத்தரவுகளைப் பிறப்பித்தேன் என அவர் என் மீது குற்றம்சாட்டியிருக்கிறார். அது பத்திரிகைகளில் வெளிவந்துள்ளது.

பகிரங்கக் கூட்டங்களில் அவர் அவ்வாறு பேசியிருக்கிறார். அவை எல்லாம் தவறான விடயங்கள். இங்கு சட்டமுறைமை இருக்கிறது. அதன்கீழ் அவரக்கு எதிராக நடவடிக்கை எடுக்கப்படும். ஆனால் அவர் வெறுமனெ எதிர்க்கட்சி வேட்பாளர் என்பதற்காகக் கைது செய்யப் போவதில்லை என்றார்.
